Vijay’s ‘Jana Nayagan’ Caught in Censor Storm Again as Madras High Court Sets Aside U/A 16+ Order

CBFC Wins Temporary Relief, KVN Productions Gets Fresh Chance as Legal Battle Heats Up Over Thalapathy Vijay’s Final Film

Thalapathy Vijay’s much-awaited final film ‘Jana Nayagan’ has once again landed in turbulent waters — and this time, the drama isn’t on screen, but inside the courtroom.

In a significant development that has sent shockwaves across the Tamil film industry and Vijay’s massive fan base, a Division Bench of the Madras High Court on January 27, 2026, allowed a writ appeal filed by the Central Board of Film Certification (CBFC) and set aside an earlier single judge order that had directed the board to grant the film a U/A 16+ certificate.

The fresh order effectively puts the film’s censor clearance back in limbo, intensifying speculation, anxiety, and behind-the-scenes chatter in Kollywood.

The Division Bench comprising Chief Justice Manindra Mohan Shrivastava and Justice G. Arul Murugan ruled that the earlier order was passed without giving the CBFC adequate opportunity to submit its counter affidavit. The judges also observed that the writ petition filed by producer KVN Productions LLP itself was technically flawed.

In legal terms, the production house had sought a mandamus — a direct instruction to the CBFC to issue certification — whereas the correct approach should have been a certiorari petition challenging the CBFC chairman’s decision to refer the film to a revising committee.

However, instead of dismissing the case outright, the court offered KVN Productions a lifeline. The Bench permitted the producers to amend their plea and allowed the petition to be restored for fresh hearing before the single judge if they choose to exercise this option.

In short: the fight is far from over.

Why ‘Jana Nayagan’ Is So Sensitive

‘Jana Nayagan’ isn’t just another big Tamil release — it is being widely touted as Vijay’s final film before his full-time political plunge, making every development around the movie headline material.

From pre-production buzz to audio launch fan frenzy in Malaysia, the film has carried massive expectations. Any delay or controversy directly impacts not only box office prospects but also Vijay’s carefully calibrated public image ahead of his political ambitions.

According to court records, the project’s journey began in May 2024, with its pooja ceremony held on October 4, 2024. Shooting commenced immediately and post-production wrapped by December 15, 2025. The grand audio launch followed on December 21, 2025.

The producers applied for certification through the CBFC’s e-cinepramaan portal under the tatkal process on December 18, 2025.

A five-member examining committee previewed the film on December 19 and unanimously recommended a U/A 16+ certificate, subject to certain excisions.

KVN Productions accepted the cuts, carried them out, and resubmitted the film on December 24. Everything seemed smooth — until the plot twist arrived.

The Complaint That Sparked the Chaos

After days of silence, the CBFC Regional Officer informed the producers on January 5, 2026, that the CBFC chairman had referred the film to a nine-member revising committee based on a complaint.

The producers were told that the complaint raised two major issues:

  1. Certain visuals allegedly disturbed religious harmony.
  2. The examining committee did not include a defence expert, despite references to the Indian Army in the film.

This sudden reversal stunned the production team, especially since the examining committee had already cleared the film with cuts.

KVN Productions rushed to the Madras High Court on January 6, seeking an urgent direction to the CBFC to issue the certificate immediately.

On January 9, the single judge ruled in favour of the producers, quashed the chairman’s referral decision, and ordered the CBFC to issue the certificate.

But within hours, the CBFC appealed — triggering the current reversal.

What the Division Bench Said

The Division Bench emphasized procedural fairness.

The judges stated that the single judge should not have passed such sweeping directions without giving the CBFC proper opportunity to file its response.

They also noted that the writ petition itself was improperly framed.

Crucially, the Bench refrained from commenting on whether the chairman’s decision was right or wrong — leaving the door open for fresh arguments.

They also highlighted that the complaint reportedly came from a member of the examining committee itself, raising eyebrows across industry circles.

However, the court stressed that these factual disputes must be examined properly through a structured legal process, not rushed orders.

Industry Buzz: Fans Nervous, Trade Alert

The development has sent Kollywood into overdrive.

Trade analysts worry that continued legal delays could disrupt release planning, overseas distribution commitments, and promotional campaigns.

Vijay’s fan clubs have already started trending hashtags demanding immediate clearance, while insiders whisper about potential political sensitivities embedded in the film’s narrative.

Given the references to the Indian Army and possible religious imagery, observers believe the revising committee could demand further modifications — a scenario that could delay release timelines significantly.

For a film positioned as Vijay’s cinematic farewell, every day of uncertainty adds pressure.

What Happens Next?

KVN Productions now has the option to amend its petition and re-approach the single judge. If they proceed, the CBFC will get a full chance to file its counter affidavit.

The single judge will then decide whether the chairman’s referral was legally valid.

Until then, ‘Jana Nayagan’ remains stuck in certification purgatory.

The big question remains:
Will the film finally secure its U/A 16+ certificate smoothly, or is this controversy only the beginning of a longer legal tug-of-war?

Why This Matters Beyond One Film

This case could set an important precedent for how CBFC decisions are challenged in court, especially under the fast-track tatkal system.

It also raises broader questions about:

  • Transparency in complaint mechanisms
  • Role of examining committee members
  • Authority of the CBFC chairman
  • Balance between creative freedom and regulatory oversight

For filmmakers across India, the verdict will be closely watched.

For Vijay fans, the wait continues.

And for Kollywood, the censor drama has become as gripping as any blockbuster script.
